La responsabilité administrative en Haïti : quand la loi existe mais ne s’applique pas

Abstract

This article aims to analyze the legal, institutional, and socio-political causes of the ineffectiveness of administrative accountability in Haiti. The study adopts a qualitative approach, primarily doctrinal and socio-legal, based on an analysis of the amended 1987 Haitian Constitution, certain texts relating to public administration, scholarly works in administrative law, and institutional reports published by oversight bodies such as the Superior Court of Accounts and Administrative Disputes, the Anti-Corruption Unit, and the Office of Citizen Protection.

The analysis shows that the difficulties in applying administrative accountability in Haiti do not stem primarily from a normative deficit, but rather from structural constraints affecting the functioning of public institutions. Among the main factors identified are the weakness of administrative and judicial oversight mechanisms, the politicization of public administration, the difficulties within the judicial system, the insufficient culture of accountability, and the limitations of citizen oversight of administrative action.

The study also highlights the sometimes symbolic nature of certain administrative norms in the Haitian context, where the formal existence of the law does not necessarily guarantee its effective application in institutional practices. Finally, the article proposes several avenues for reflection aimed at strengthening oversight institutions, professionalizing the public administration, developing a culture of administrative transparency, and improving mechanisms for citizen participation in Haitian public governance.
