Réforme de la justice en contexte de procès contre la sécurité publique en Haiti

Abstract

For four decades now, studies and investigations encompassing various aspects of the issues of law, justice and security, judicial administration, policing, and the prison system have been conducted with the participation of local and international experts. Laws have been passed, measures adopted, even in a context of difficult implementation. Yet, forty years after the nominal fall of the Duvalier (Father and Son), the results speak of failure, or of limited progress made at best. Is that due to a lack of effort and investment? Have the past four decades been spent in endless talk, procrastination, discussions, and diagnoses without action? This reflection aims to answer these questions. It also addresses the trend—now becoming the norm—among state actors of promoting, and viewing justice reform as a vehicle for granting themselves power, and effectively placing public security on perpetual trial. The track record to date offers no evidence to the contrary. The considered analytical methodology follows a linear progression, linking initiatives to specific measures (interventions or actions) and results sought, achieved or actually found therefrom. The equation has remained, so to speak, unbalanced.
